September 2019 Visa Bulletin Update

The Department of State has posted the visa bulletin for September 2019.

EB-1 Priority Workers final action date has slid back to October 1, 2017 for all nationals, except those born in China with a cutoff date of January 1, 2014 and those born in India with no visas available in this category.

All other  employment based categories are backlogged as shown in the chart below:

“U” indicates that the visas in the category are “unsubscribed” meaning unavailable.

The USCIS announced that it will accept adjustment of status applications in September for family-based petitions for those with priority dates before the listed cutoff date in the filing dates chart. For employment- based petitioners, the USCIS will accept adjustment of status applications in September for those with priority dates before the listed cutoff date in the final action chart.

However, for both family and employment based petitions, your priority date must be earlier than the date in the final action chart for final approval of your immigrant visa or adjustment of status application.
